The Council of Ministers of the Federal Government of Somalia held an extraordinary meeting tonight to deliberate on the implementation and operationalization of the national Constitution, approving a key resolution regarding the execution of constitutional provisions.
The meeting, chaired by the Prime Minister of the Federal Government of Somalia, Hamza Abdi Barre, focused on accelerating constitutional implementation, particularly the drafting of critical legislation regulating the structural framework and functions of the Federal Executive.
During the session, the Council of Ministers formally approved the Resolution to Operationalize the Constitution and appointed a ministerial committee tasked with expediting activities linked to implementing constitutional provisions.
According to the official communique issued following the Cabinet meeting, the newly established committee is chaired by the Minister of Justice and Constitutional Affairs, mandated to spearhead constitutional execution.
The primary duty assigned to the committee includes drafting the Government Formation Act, which must be finalized within a strict two-month timeframe.
This legislation governs the procedural mechanisms for forming the government, regulating cabinet membership thresholds, and defining operational responsibilities for executive departments in accordance with constitutional provisions.
The meeting communique highlighted that this legislation governing executive structure will be the first of its kind in the country since 1968.
The formulation of this act is expected to serve as the foundational framework for establishing the statutory size of the government and delineating institutional duties, ensuring a standardized legal mechanism guides the formation and operation of the Council of Ministers.
The committee tasked with drafting the legislation has been allocated a two-month timeframe, which is the deadline set for completing its mandated duties.
The approval of this resolution and the appointment of the committee form part of the Federal Government of Somalia’s measures aimed at accelerating the operationalization of the Constitution.
The Constitution serves as the foundational framework for state governance, institutional powers, and their respective jurisdictional mandates, while enabling supplementary legislation provides detailed operational mechanisms for enacting constitutional provisions into state function.
Attention now turns to the committee’s execution over the designated two-month window and the drafting of the act defining the structure, size, and portfolio responsibilities of the Federal Executive.
